Why an Anti-Gay Rally Is Allowed to Use Your Music

It was another shocking moment for a band with a popular song.  As Kim Davis stepped on stage in front of a cheering Christian extremist audience, Survivor’s ‘Eye of the Tiger’ played in the background, even though the band never offered their permission.  The members of Survivor simply don’t support the anti-gay rhetoric and stance of Kim Davis and her supporters, and more importantly, they didn’t want their song played during the rally.

That led to legal threats from the band’s founder, Jim Peterik.

Simple violation of copyright?  Not at all: just days earlier, the members of R.E.M. railed against Donald Trump for playing “It’s the End of the World As We Know It (And I Feel Fine),” even though the band never would have authorized such use.  But in both the Survivor and R.E.M. situations, there’s little legal recourse the bands can take.

“…they’re in the clear.”

In fact, both Davis and Trump are completely within their legal rights to use whatever music they want, as long as they’re paying the appropriate performance rights organization ASCAP, BMI, SESAC, or GMR.  “In most cases, the event organizers have taken out a PRO license, so they’re in the clear,” explained Steve Gordon, a music industry attorney and author of the book, The Future of the Music Business.  “But even if they haven’t [secured the proper licenses], the artist still needs to demonstrate actual damages, which can be difficult.”

Those damages can theoretically reach $150,000 per infringed work, according to US copyright law.  But according to Gordon, a jury still has to award that, and in most cases, they’d never go that high.<!–/*

// ]]>There are other potential legal arguments, including trademarking and invalid associations with the band.  But those are theoretical, and totally untested in actual court.  Which means that in most cases, a band starts looking at legal costs, endless hassle, and time drain, most of these cases fizzle out quickly.

And if they don’t, they could be handing the right defendant a perfect amount of publicity.  “Trump would absolutely love a lawsuit from R.E.M.,” Gordon laughed.  “He’d relish that.”

‘Evidence’ Exists That Radio DJ Grabbed Taylor Swift’s Ass, Representative Says

Last week,  KYGO disc jockey David Mueller sued Taylor Swift and her management group after being accused of grabbing, groping or otherwise inappropriately touching Taylor Swift’s ass at a Denver show in 2013.  Mueller was initially accused of the trespass at the show, kicked out by security, and subsequently fired.

The only problem is that Mueller may be totally innocent.

“The contention that Mr. Mueller lifted up Ms. Swift’s skirt and grabbed her bottom, while standing with his girlfriend, in front of Ms. Swift’s photographer and Ms. Swift’s highly trained security personnel, during a company sponsored, VIP, backstage meet-and-greet, is nonsense, particularly given that Ms. Swift’s skirt is in place and is not being lifted by Mr. Mueller’s hand in the photograph,” the complaint stated.<!–/*

That photograph remains unpublished but may be critical to this case, especially since damages could cross into the millions.  Whether the ass-grab occurred in another situation is unclear, though the accusation appears to be focused on a photograph  taken of Mueller, Mueller’s girlfriend, and Taylor Swift.  According to the filings, that appears to be the only time that Mueller was in close physical proximity of Swift, though a representative of the camp now says hard evidence exists of a violation.

“The radio station was given evidence immediately after the incident. They made their independent decision,” Swift’s spokeswoman Tree Paine told CNN.

Nothing further details on this piece of evidence was supplied.

YouTube Music Is Growing 60% Faster Than All Other Streaming Music Services Combined

Does this make any sense?  Spotify is struggling to add paying subscribers, while YouTube music video views are surging on greater selection and totally free content.  In fact, according to stats compiled by Nielsen, YouTube delivered 60.6 percent more streams than all audio-only streaming music services combined, free or paid, during the first half of 2015.

Overall, YouTube (which includes VEVO) served 76.6 billions music video streams during the first half of this year, a gain of 109.2 percent, while all other audio-only streaming music services delivered 58.6 billion streams, a gain of 74.2 percent.  That’s a different of 18 billion songs

Overall, music streams (video+audio) surged 92.4 percent to 135.2 billion for the half-year.

Spotify now counts 20 million paying subscribers, and 55 million free, ad-supported users.  YouTube’s planned paid platform, Music Key, doesn’t have a known launch date.

Radio DJ Says He Never Grabbed Taylor Swift’s Ass

This is all about what did, or didn’t, occur at the Pepsi Center in Denver on the night of June 2nd, 2013.  At the center of the allegations is KYGO radio personality David Mueller, aka ‘Jackson,’ who was accused of grabbing, touching, or otherwise groping Taylor Swift’s rear end, and quickly lost his job as a result.

Now, Mueller is firing back against those charges in court.  In a complaint filed with the US District Court in Denver, Mueller says he was falsely accused of the ass-grab by a member of Swift’s security detail, which led to damages that included getting fired.

Amazingly, the filing points to an accusation of actually reaching up Taylor Swift’s skirt.

“The contention that Mr. Mueller lifted up Ms. Swift’s skirt and grabbed her bottom, while standing with his girlfriend, in front of Ms. Swift’s photographer and Ms. Swift’s highly trained security personnel, during a company sponsored, VIP, backstage meet-and-greet, is nonsense, particularly given that Ms. Swift’s skirt is in place and is not being lifted by Mr. Mueller’s hand in the photograph,” the complaint states.

Mueller was earning a base salary of $150,000 a year, as well as various performance bonuses and endorsements, according to the suit.  That’s just the beginning of potential damages, though according to Billboard, Swift’s publicist says evidence was submitted in the case, though that evidence will undoubtedly be re-evaluated by a judge.  Enter the actual photograph of Mueller, who posed with both his girlfriend and Swift, and has yet to surface.
